CMA Review of Environmental Claims and Proposed Future Approach

Further to this news item announcing the review of environmental claims by the Competition and Markets Authority (CMA), the regulator has now completed its review, publishing on 21 May 2021 draft guidance on the applicability of consumer protection law to environmental claims.  The draft guidance is open for consultation until 16 July 2021.  The final version of the guidance is scheduled to be published in August/September 2021.

CTPA will liaise with its Compliance and Regulatory Committee and Claims and Advertising Working Group to submit its response; companies are also encouraged to individually take part into the consultation and submit the responses to [email protected].

This comes as a result of an investigation carried out by the International Consumer Protection Enforcement Network (ICPEN), of which the CMA is part, which found that 40% of environmental claims are misleading.

Alongside the above, the CMA will also issue a short guide for consumers to help them understand the questions they should be asking themselves when deciding whether or not they should trust environmental claims being made by businesses.
