ECJ Ruling on Cosmetic Function Labelling

On 17 December 2020, the European Court of Justice (ECJ) issued a ruling on the labelling of the cosmetic product function.  The press release is available here.

The ECJ ruling confirms the current requirement under Article 19 of the EU Cosmetics Regulation that the function of the product and its instructions for use need to be labelled, unless they are obvious.  This is also based on considering the understanding of the average consumer who would know how to use the product.

The specific issue in the ECJ case is related to a product which did not have any labelling information on the product function and instructions for use, and this was not clear from the product’s presentation.
