New: Guidance on EU GPSR Article 19

Cosmetics Europe guidance on the application of the EU GPSR to cosmetic products.

On 28 November 2023, Cosmetics Europe (CE) published its guidance document on the application of Article 19 of the EU General Products Safety Regulation (EU GPSR) to cosmetic products.

Not all the provisions of the EU GPSR apply to cosmetic products as cosmetic products are regulated under the EU Cosmetic Products Regulation (CPR) which imposes specific safety requirements.  The GPSR applies only to risks, or categories of risks, which are not covered by the CPR requirements.  Article 19 of the EU GPSR requires that, where economic operators make products available on the market online or through other means of distance sales, the offer of those products clearly and visibly indicates certain information.

The CE guidance document intends to provide, through a harmonized interpretation, more clarity to the value chain on the application of Article 19 to cosmetic products.  Article 19 is worded towards all consumer product types, and it is therefore essential that the required information is interpreted through the lens of the CPR.
