On 26 June, the Health and Safety Executive (HSE) added 88 chemical substances to the GB Mandatory Classification List (MCL). This introduces new mandatory classifications under Article 37 of the GB Classification, Labelling and Packaging (CLP) Regulation for these substances. These substances were part of the 14th and 15th Adaptations to Technical Progress (ATP) to the EU CLP Regulation.
Below is a list of substances which have an INCI name and may therefore be used as cosmetic ingredients that have a proposed Carcinogen, Mutagen or toxic for Reprotoxic (CMR) classification, triggering Article 15 of the UK Cosmetics Regulation (UKCR).
- Octamethylcyclotetrasiloxane (D4) as CMR2 (reprotox) à this ingredient is already in Annex II of the UK Cosmetics Regulation (UKCR).
- Butylphenyl methylpropional (BMHCA)/’lilial’as CMR1B (reprotox) à this ingredient is already in Annex II of the UK Cosmetics Regulation – it was implemented with this Statutory Instrument in 2022.
- Benzyl dimethylamino morpholinophenyl butanone as CMR1B(reprotox) à this ingredient is already in Annex II of the UKCR.
- Methoxyethyl acrylate as CMR1B (reprotox) and CMR2 (muta) à this ingredient is already in Annex II of the UKCR. Members are reminded that in the EU this ingredient has a harmonised classification as CMR2 (reprotox) and CMR2 (muta).
- Sodium hydroxymethylglycinate (SHMG) as CMR1B (carc) and CMR2 (muta) à regulatory management was implemented with this Statutory Instrument in 2022. The HSE has however proposed a different mandatory classification compared to the EU for other hazard categories.
- Zinc pyrithione (ZnPT) as CMR 1B (reprotox) à regulatory management was implemented with this Statutory Instrument in 2022. The HSE has however proposed a different mandatory classification compared to the EU for other hazard categories.
These GB MCL come into effect on date of publication, 26 June 2024.
The following substances which had a harmonised CMR classification as part of the 14th and 15th ATP to EU CLP do not have a mandatory CMR classification in the GB MCL for GB CLP: pentasodium pentetate, pentetic acid, titanium dioxide in powder form.
CTPA only monitors proposals for mandatory CMR classifications under the GB or EU CLP Regulations. Please be aware the other hazard categories may have different proposals for mandatory classifications in GB compared to the EU, and these can impact the Safety Data Sheets (SDS), labelling or other documentation for the raw material.
