On 27 October 2023, the Office for Product Safety and Standards (OPSS) notified to the World Trade Organisation (WTO) the Statutory Instrument (SI) amending Annex III of the UK Cosmetics Regulation. This amendment implements the opinion of the Scientific Advisory Group on Chemical Safety (SAG-CS) on BHT.
The notified SI add butylated hydroxytoluene (BHT) to Annex III of the UK Cosmetics Regulation with the below restrictions:
- toothpaste at 0.1%;
- mouthwash at 0.001%;
- leave-on oral care products at 0.001%;
- other leave-on and rinse-off products at 0.8%.
The proposed restriction is in line with that of the EU Cosmetic Products Regulation for BHT; there is an additional restriction for leave-on oral care products at 0.001% compared to the EU.
The proposed placing on the market deadline is 6 October 2024; the proposed making available (off-shelf) deadline is 6 February 2025.
The notification is open for comments for 60 days from the date of notification.
