CFS Requirements for Trading with CPTPP Countries

The UK’s accession to the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) has entered into force, meaning that UK businesses can now benefit from the provisions within the Agreement to trade with Australia, Brunei, Canada, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore, and Vietnam. 

The Agreement includes a dedicated Cosmetic Annex (8-D) within the Technical Barriers to Trade (TBT) Chapter.  Article 19 of Annex 8-D specifically states that traders from a CPTPP member cannot be required to provide CFS for cosmetic products as a condition to market, distribute or sell the product in another CPTPP member’s country.  This means companies no longer need to present a CFS for cosmetic products to the authorities in these countries. 

To this effect, the UK Government will not deliver CFS to UK businesses for CPTPP countries.  However, the government is keen to engage with businesses experiencing difficulties where CPTPP countries are requiring a CFS in practice.  Companies are invited to get in touch with Claire Payne, Deputy Head of Implementation, FTA Utilisation at the Department for Business, Innovation, Science and Trade (BIST).
