Intellectual Property Office on Exhaustion of IP Rights and Parallel Trade

The Intellectual Property Office (IPO) has launched a consultation on the UK´s future regime for exhaustion of IP rights, which underpins the system of parallel trade.  The IPO is seeking evidence to understand what the most appropriate regime would be now that the UK has left the EU and how that change should be implemented. 

The consultation proposes several options available which will need to be tested through consultation, including:

  • national exhaustion;
  • a continuation of the existing regime introduced on 1 January 2021, following the UK withdrawal from the EU;
  • an international regime;
  • a mixed regime.

The consultation will remain open until the 31 August 2021.
