EU Commission Inception Impact Assessment on the Review of the EU Cosmetics Regulation

On 4 October 2021, the EU Commission issued the inception impact assessment for the review of the EU Cosmetic Products Regulation (CPR).  The revision of the CPR comes in parallel with that of the Classification, Labelling and Packaging (CLP) and Registration, Evaluation, Authorisation of Chemicals (REACH) Regulations in the light of the objectives of the EU Chemical Strategy for Sustainability (CSS).

In order to achieve the objectives of the CSS, the impact assessment will analyse:

  • options including the extension of the existing or modified provisions restricting CMRs (Article 15 of CPR) to further hazard classes, review the criteria and processes to decide on exceptions to bring them in line with the essential use concept currently developed under CSS, and introducing provisions to take account of combination effects;
  • effectiveness, efficiency and coherence of safety assessments across EU legislation as well as to ensure the best use of expertise and resources in the Agencies (such as the European Chemicals Agency – ECHA);
  • the definition of nanomaterial to ensure coherent terminology across chemicals legislation;
  • the way in which specific product label information is provided, with the possibility to introduce digital labelling.

The impact assessment is open for feedback until 1 November 2021.  A 12-week public consultation will follow this first stage of the review of the CPR.  Companies are invited to contribute to the impact assessment; CTPA will liaise with Cosmetics Europe in compiling a response.
