Borderlines with Cosmetics: Spotlight on Medical and Biocidal Classifications

Product classification is essential to understand the regulatory requirements applicable to each individual product.  It allows companies to understand their legal compliance requirements, ensures products are safe, and protects consumers from being misled into believing products may have functions which they do not.  

To classify products, each regulation will contain definitions of the products included within their scope.  Classifying products under these definitions usually relies on a series of fundamental factors which need to be assessed on a case-by-case basis.

Cosmetic products share a borderline with other product categories, such as medicines, biocides, or general products.  In this webinar, CTPA is joined by the Medicines and Healthcare products Regulatory Agency (MHRA) and the Health and Safety Executive (HSE) to look at specific borderline examples with medical and biocidal products.

The presentation being delivered by HSE will first cover the legal definition of a biocide, and how biocidal products are categorised.  It will then go on to provide an overview of the regulatory framework, including the process to grant permissions.  Finally, the presentation will explain the categorisation of some common biocide/cosmetic borderline products.

The MHRA will review where the status of products on the borderline between medicines, medical devices and cosmetics may not always be immediately obvious.  By looking at a wide range of products including hand sanitisers, topical disinfectants, toothpastes, skincare products, spot and acne products and shampoos, which may fall under any of these three regulatory areas depending on their function and intended purpose, MHRA hope to be able to provide some clarity.

The webinar will be relevant for any person working in R&D, Regulatory and Compliance, Legal, Brand Marketing or Brand Managing, as well as any other person involved with claims and product design.
